The ICAO Master List  and Health Master List download (the "Service") is an online information service provided by ICAO, subject to your compliance with the Terms and Conditions set forth below.

Please read the Terms and Conditions carefully before accessing or using the Service. By accessing or using the Service, you agree to be bound by the Terms and Conditions set forth below. If you do not wish to be bound by these Terms and Conditions, you may not access or use the Service. If you utilize the Service in a manner inconsistent with these Terms and Conditions, ICAO may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse indicate is proper. ICAO may modify the Terms and Conditions at any time, and such modifications shall be effective immediately upon posting of the modified Terms and Conditions. You agree to review the Terms and Conditions periodically to be aware of such modifications and your continued access or use of the Service shall be deemed your conclusive acceptance of the modified Terms and Conditions.

Authorised and Prohibited Uses.

1. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use Master List content in any way except for your own personal/ organizational non-commercial use. You also agree not to adapt, alter or create a derivative work from any content except for your own personal, non-commercial use. Any other use of the content requires the prior written permission of ICAO.
2. You agree to use the content only for lawful purposes. You will comply with all applicable laws in connection with your use of this Service.
3. You may not otherwise, directly or indirectly, resell, publish, repackage or otherwise disseminate Master List content or the Website, or any portion thereof, in any medium in any manner whatsoever. You shall not use any such content in any manner that may or does infringe any proprietary or intellectual property rights of ICAO, or those of any third party.
4. You shall not, and shall procure that the users of the Master List(s) and/or ICAO PKD shall not, intentionally:          
• attempt to access any information on the Website of the ICAO PKD that is denied to it by the normal operation thereof;
• use the Website of the ICAO PKD in any manner intended to cause damage or disable the Website, or the ICAO PKD, or interfere with any other person's use of the Website or the ICAO PKD; and/o
• use any robot, spider or other automatic device or software program to monitor, copy or interfere with any web pages on the Website giving rise to the actions in the foregoing Clauses above.

Use of the Service and Disclaimers.

5. You understand that ICAO cannot and does not guarantee or warrant that files available for downloading through the Service will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Service for the reconstruction of any lost data.
6. You assume total responsibility and risk for your use of the Service. ICAO does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or noninfringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the Service, any merchandise, information or service provided through the Service , and ICAO shall not be liable for any cost or damage arising either directly or indirectly from the use or inability to use the Service. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the Service. ICAO does not warrant that the Service will be uninterrupted or error-free or that defects in the Service will be corrected. The Service and any software made available on the Service are provided on an "as is, as available" basis.
7. ICAO may in its discretion modify, edit, translate, suspend, restrict access to or terminate the Service, this Website, these Terms and Conditions, the content or any link at any time without liability or prior notice. ICAO may in its discretion terminate your browsing and use of this Website at any time without liability or prior notice for any reason, including for any breach of these Terms and Conditions.
8. ICAO disclaims all liability, direct or indirect, for any claim relating to the use of or the inability to use the Service or any information therein, including without limitation claims arising from product liability, personal or bodily injury, or infringement of any proprietary rights. In no event shall ICAO be liable for any loss, damage, liability or expense incurred that is claimed to have resulted from the use of or the inability to use the Service or any information therein, including without limitation, any errors or omissions, other inaccuracies, interruption or delay with respect thereto. Under no circumstances shall ICAO be liable for any direct, incidental, consequential or indirect damages (including, but not limited to loss of profits, business interruption, loss of programs or information and the like) arising out of the use of or inability to use the Service or the information therein, even if ICAO has been advised of the possibility of such damages.

Indemnification.

9. You agree to indemnify, defend and hold harmless ICAO, its officers, directors, employees, agents, licensors, suppliers, contractors and any third party information providers to the Service from and against all demands, claims, losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement by you. You will defend, indemnify and hold harmless ICAO officers, directors, employees and contractors from any demands, claims, damages, liabilities, expenses or harms, including attorneys' fees, arising in connection with your use of the Service or of the content from this Website, online conduct, dealings or transactions with other persons resulting from use of the Service or from the content of this Website.

Miscellaneous.

10. You represent and warrant that you are authorized to enter into these Terms and Conditions on behalf of any entity that you represent. These Terms and Conditions may only be modified by ICAO, at its sole discretion. If any provision of these Terms and Conditions is held to be invalid or unenforceable for any reason, then the remaining provisions will remain in full force and effect. Your obligations pursuant to these Terms and Conditions shall survive termination of this Web Site, any use by you of this Web Site and any Content, or these Terms and Conditions.

Disputes.

11. Disputes relating to or arising from the use of or the inability to use the Service shall be submitted to arbitration in accordance with the UNCITRAL Arbitration Rules then prevailing to be conducted by a sole arbiter in Montreal.

Privileges and Immunities.

12. Nothing herein or related hereto shall be deemed to be a waiver of the privileges and immunities enjoyed by ICAO, which are specifically reserved.
