ICAO USOAP CMA Community


Terms of Use

ICAO USOAP CMA Community is a subscription-based professional community web platform, which brings together the National Continuous Monitoring Coordinators (NCMCs), ICAO Officials and other USOAP stakeholders in order to engage, consult and support them more effectively in their USOAP CMA activities.

The Community forum is moderated by the ICAO Air Navigation Bureau’s Monitoring, Analysis and Coordination (MAC) unit and powered by Mighty Networks. The views expressed in the professional discussions do not represent the official position of ICAO, its Officials, nor do they engage ICAO or its Officials in any way.

The acceptance of an invitation to join and use of the Community website www.usoap-community.icao.int with all pages in this domain, constitutes acceptance of the following Terms of Use.
 

DISCLAIMER

ICAO disclaims any liability or responsibility arising from the use of the USOAP CMA Community website.

As a condition of use of this website, the user agrees to indemnify ICAO, its Officials and partners from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of the use of the content of the USOAP CMA Community website, including the inappropriate, improper, or fraudulent use of such content. If the user is dissatisfied with any material on the USOAP CMA Community website or with any of terms and conditions of use of the said website, such user's sole and exclusive remedy is to discontinue using the Community website.

The designations employed, opinions expressed, and the presentation of information on the USOAP CMA Community website do not imply the expression of any opinion whatsoever on the part of ICAO or its Officials concerning the legal or development status of any State, territory, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries. No part of these Terms of Use shall constitute or be interpreted as a waiver of the privileges and immunities of ICAO and its Officials. ICAO reserves its exclusive right in its sole discretion to alter, limit or discontinue the Community website or any materials in any respect. ICAO shall have no obligation to take the needs of any user into consideration in connection therewith.

The USOAP CMA Community website may contain links and references to third-party websites.

Hyperlinks to non-ICAO websites are provided only for information or research purposes, and do not imply any official endorsement of or responsibility on the part of ICAO for the opinions, ideas, data or products presented at these locations, or guarantee the validity of the information provided. The sole purpose of links to non-ICAO websites is to indicate further information available on related topics. The information is provided on the basis that users accessing the platform assume responsibility for assessing its relevance, accuracy and suitability for application.

The USOAP CMA Community website may include third party copyright material for which rights and permissions must be obtained from the copyright holder(s) indicated.

Users are encouraged to establish hyperlinks to the USOAP CMA Community website and prior permission is not required. ICAO logo must not be used, unless prior permission has been granted.
 

DISCUSSION/CONSULTATION FORA AND COMMENTING TOOLS

The USOAP CMA Community website contains specialized fora for discussion or consultation and commenting tools. When participating, users agree not to:
  • defame, abuse, harass, threaten or otherwise violate the rights of others;
  • publish, post, distribute or disseminate defamatory, infringing, obscene, indecent or unlawful material;
  • upload or attach files that contain software or other material protected by intellectual property laws unless the user owns or controls the rights and has received all necessary permissions;
  • upload, email, transmit or otherwise make available unsolicited advertising of any goods or services, or conduct or forward surveys, contests, "spam" or chain letters, etc.

Users specifically acknowledge that ICAO or its Officials are not liable for the conduct of any other user on the USOAP CMA Community website. Users posting material that falls into the above categories will be removed and/or banned from participating in the related fora and commenting tools.
 

SECURITY AND NON-DISCLOSURE

For site security purposes and to ensure that this service remains available to all users, ICAO monitors network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

Except for authorized investigations and to maintain required correspondence files, no other attempts are made to identify individual users or their usage habits. Raw data logs are used to determine the number of users and, occasionally, which general domains are accessing the ICAO websites.

Any information provided to ICAO by users is held with the utmost care and security, and is not used in any manner other than that set forth in the Privacy Policy, or in any additional site-specific policies.

All ICAO Officials who have access to or are associated with the processing of personal data are obliged to respect the confidentiality of official business matters, including personal data.

No user may release any technical data or other information or material related to the Fora and commenting tools to third parties. 
 

NOTIFICATION OF AMENDMENTS

ICAO reserves the right to amend this Terms of Use without notice and at its own discretion.
